Is Kalshi legal in your state? Sports contracts, lawsuits and age rules (2026)
Kalshi is federally regulated and available across the US, but its sports contracts are fighting state gaming regulators in court. Here is where things stand and how to check your state.
In this article
Kalshi is legal at the federal level: it is an exchange regulated by the CFTC, and its markets on economics, weather, politics and culture are available to adults across the United States. The question in 2026 is narrower: sports event contracts, which many states treat as unlicensed sports betting.
The legal picture changes month by month. This summary reflects October 2026; Kalshi's app shows what is available at your location.
How is Kalshi legal?
Kalshi is a designated contract market, the same category as futures exchanges. Under the Commodity Exchange Act, the CFTC, not the states, regulates trading on those exchanges. Kalshi's argument is that this federal law preempts state gambling laws for the contracts it lists. That argument has held for most markets; sports are where states push back.
Why sports contracts are different
States license and tax sportsbooks. When Kalshi began listing game-winner and season contracts, state gaming regulators argued they are sports bets dressed as derivatives. The result is a string of cease-and-desist letters and lawsuits, and federal appeals courts that disagree:
- The Third Circuit sided with Kalshi against New Jersey; New Jersey asked the Supreme Court to take the case.
- The Sixth Circuit ruled in September 2026 that Ohio and Tennessee can enforce their sports betting laws against Kalshi.
- Nevada won rulings in federal court and at the Ninth Circuit requiring a gaming licence.
- Massachusetts obtained a state court order against Kalshi's sports contracts.
- Connecticut, Maryland, Arizona and others have sued or issued orders, with cases still open.
Because the circuits are split, many expect the Supreme Court to settle the question.
Is Kalshi legal in California, Texas, Florida and Washington?
These are among the most searched states. According to public trackers in October 2026:
- Texas: Kalshi is available, sports contracts included, and the state has not acted against it (Kalshi in Texas).
- California: Kalshi is available, sports included, but after a September 2026 Ninth Circuit ruling for three tribes it blocks their reservations (Kalshi in California).
- Florida: Kalshi is available, sports included; the governor has questioned it, but there is no enforcement action (Kalshi in Florida).
- Washington: after a state court order in August 2026, Kalshi blocks sports, election and other event contracts (Kalshi in Washington).
- Also asked about: New York (available, but sued for $36 billion), Nevada (not available), Georgia (available), Hawaii (available despite the state's gambling ban), Michigan (sports blocked by a court order), Ohio (sports under a cease-and-desist) and Utah (sued by the state in October 2026).
Treat any state list, including this one, as a snapshot. The Kalshi app geolocates you and only shows markets you can trade, which is the reliable check.
Is Kalshi gambling?
Federal law treats Kalshi's contracts as derivatives on a regulated exchange, not wagers, and you trade them against other users rather than against a house. Several states disagree for sports specifically. Whatever the label, you can lose money, so treat it with the same care as any speculative trading. See is Kalshi legit for how your funds are protected.
How old do you have to be to use Kalshi?
18. Kalshi requires identity verification (name, address, date of birth and ID) before you can trade or withdraw.
What about Polymarket?
Polymarket's US exchange faces many of the same state challenges, especially over sports. Read is Polymarket legal in the US and our full Kalshi vs Polymarket comparison.
Kalshi legality: frequently asked questions
Why can Kalshi offer sports contracts where sportsbooks need a licence?
Kalshi argues that federal commodities law, enforced by the CFTC, preempts state gambling laws for contracts on a regulated exchange. Several states and some federal courts disagree for sports, which is why the issue is likely headed to the Supreme Court.
Will I get in trouble for using Kalshi?
Enforcement actions so far target the platform, not its users. Kalshi blocks markets it cannot offer at your location.
Are non-sports markets affected?
Largely no. Markets on economics, weather, politics and culture have not been the focus of the state cases.
Is Polymarket in the same position?
Mostly, yes: its US exchange faces similar challenges over sports. See is Polymarket legal in the US.
